Hays </HACK> Competition Terms and Conditions

Please read the following terms and conditions carefully prior to entry to ensure you fully understand how Hays </HACK > works and for the conditions attached to participating in the Competition. You agree that submission of an entry in the Competition constitutes your agreement to these terms and conditions. 

These Terms and Conditions constitute the entire agreement between you and by Agensi Pekerjaan Hays (Malaysia) Sdn Bhd and you agree to, and consent to the treatment of your information in accordance with Hays’ Privacy Policy. 

Upon participating in the Competition, you also automatically agree to comply to the Terms of Services from ShowTech, whose terms you can separately access below:

This Competition is organized by Agensi Pekerjaan Hays (Malaysia) Sdn Bhd (“Hays”).

Competition Period

The Competition period will run from the 1st May 2023 to 31st May 2023 as set forth on the Competition Website. Any updated or additional deadlines will be publicised on the Competition Website and notified via email. It is your responsibility to check the ShowTech Website and emails regularly to stay informed of any deadline changes.

Conditions of Entry 

To enter the Competition, you must register on the Competition Website, the registration period is from the 1^st May 2023 until 11:59PM 31^st May 2023. Any entries received after this time will not be accepted.

As the person participating (i.e. the participant) you must:

• Be a registered account holder at Hays and app.showtech.io
• Be residing in Malaysia.
• Older of 21 years old or the age of majority
• Agree to and comply with any requested third parties’ terms and conditions.

Hays reserves the right to verify eligibility and to adjudicate on any dispute at any time. If you provide any false information relating to the Competition concerning your identity, residency, mailing address, telephone number, email address, ownership of right, or information required for entering the Competition, you may be immediately disqualified from the Competition.

Rewards 

There will be 1 winner from each category. Each winners will be awarded RM 1000 bank cheque. The prize is supplied by Hays. Hays reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond their control make it necessary to do so. Prizes for the winners are non-exchangeable & non-transferable. 

Each Coding Submission will be scored and ranked by the evaluation metric set forth on the Competition Website. Winner(s) are determined solely by the leaderboard ranking on the private leaderboard as set forth on the Competition Website, subject to compliance with the Terms and Conditions. The participant with the highest score across each assessment will be the winner. In the event the scores are identical, the participant who completed the coding assessment in the shortest time will be the winner. In the event a potential winner is disqualified for any reason, the participant with the next highest score will be chosen as the winner.

 
Hays will notify the potential winners by email (using details provided at entry) before and winners must provide a Malaysia postal address to claim their prize. If a winner does not respond to this email within 7 days of being notified by Hays, then the winner’s prize will be forfeited, and Hays will be entitled to select another winner in accordance with the process described above.

Winners will be invited to collect their prize at the Hays office. In the event the winner is unable to collect their prize, it will be sent by post within 14 days of being notified of their win.

 
The winner’s list will be publicly displayed by Hays. Winners may be required to participate in publicity related to the prize draw and the winner hereby agrees and consent to be included in the publication of their name and photograph in any media or social media.

Exclusions  

Upon participating in the hackathon, you acknowledge and agree that:

• A participant can only enter once under one account. You will be disqualified if you make entries through more than one account or attempt to falsify an account to act as your proxy.
• A participant must be currently residing in Malaysia.
• The reward is not transferable or exchangeable and not redeemable for cash; 
• You will refund, upon demand at any time, any reward where you are found to be in breach of these Terms and Conditions; 
• Hays and its suppliers do not accept any responsibility for participants not successfully completing the hackathon due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind; 
• Hays and its suppliers exclude their liability for lost or stolen bank cheques.
• Hays reserves the right to offer an alternative reward of the same value at any time; 
• Hays’ decision is final.

Competition Data

“Competition Data” means the data or datasets available from the Competition Website for the purpose of use in the Competition, including any prototype or executable code provided on the Competition Website.

1. Data Access and Use. Unless otherwise restricted under the Terms and Conditions, after your acceptance of the Terms and Conditions, you may access and use the Competition Data for the purposes of the Competition only.
2. Data Security. You agree to use reasonable and suitable measures to prevent persons who have not formally agreed to the Terms and Conditions from gaining access to the Competition Data. You agree not to transmit, duplicate, publish, redistribute or otherwise provide or make available the Data to any party not participating in the Competition. You agree to notify Hays immediately upon learning of any possible unauthorized transmission or unauthorized access of the Data and agree to work with Hays to rectify any unauthorized transmission. You agree that participation in the Competition shall not be construed as having or being granted a license (expressly, by implication, estoppel, or otherwise) under, or any right of ownership in, any of the Data.
3. External Data. Hays reserves the right in its sole discretion to disqualify any Participant who has undertaken or attempted to undertake the use of data other than the Competition Data, or who uses the Competition Data other than as permitted by the Competition Website and the Terms and Conditions.

General Conditions

Hays reserves the right to disqualify any entrant from the Competition if, in Hays’s sole discretion, it reasonably believes that the entrant has attempted to undermine the legitimate operation of the Competition by cheating, deception, or other unfair playing practices or abuses, threatens or harasses any other entrants or Hays.

Privacy

You acknowledge and agree that Hays will collect, store and otherwise use personally identifiable information provided during the registration process and the Competition, including, but not limited to, name, mailing address, phone number, and email address. Hays will use this information in accordance with its Privacy Policy, including for administering the Competition. You acknowledge that you have the right to request access, review, rectification or deletion of any personal data held by Hays by request to Hays.

Warranty, Indemnity and Release

You warrant that your Submission is your own original work and, as such, you are the sole and exclusive owner and rights holder of the Submission, and you have the right to make the Submission and grant all required licenses. You agree not to make any Submission that: (i) infringes any third party proprietary rights, intellectual property rights, industrial property rights, personal or moral rights or any other rights, including without limitation, copyright, trademark, patent, trade secret, privacy, publicity or confidentiality obligations; or (ii) otherwise violates any applicable law.

You hereby release Hays from any liability associated with: (a) any malfunction or other problem with the Competition Website; (b) any error in the collection, processing, or retention of any Submission; or (c) any typographical or other error in the printing, offering or announcement of any Prize or winners.

Internet

Hays is not responsible for any malfunction of the Competition Website or any late, lost, damaged, misdirected, incomplete, illegible, undeliverable, or destroyed Submissions or entry materials due to system errors, failed, incomplete or garbled computer or other telecommunication transmission malfunctions, hardware or software failures of any kind, lost or unavailable network connections, typographical or system/human errors and failures, technical malfunction(s) of any telephone network or lines, cable connections, satellite transmissions, servers or providers, or computer equipment, traffic congestion on the Internet or at the Competition Website, or any combination thereof, which may limit an entrant’s ability to participate.

Right to Cancel, Modify or Disqualify

If for any reason the Competition is not capable of running as planned, including without limitation to force majeure, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Competition, Hays reserves the right at its sole discretion to cancel, terminate, modify or suspend the Competition. Further Hays reserves the right to hold void, cancel, suspend or amend the Competition where it becomes necessary to do so. Hays further reserves the right to disqualify any entrant who tampers with the submission process or any other part of the Competition or Competition Website. Any attempt by an entrant to deliberately damage any web site, including the Competition Website, or undermine the legitimate operation of the Competition is a violation of criminal and civil laws and should such an attempt be made Hays reserves the right to seek damages from any such entrant to the fullest extent of the applicable law.

Liability and Governing Law 

Except to the extent not permitted by law, Hays fully excludes is liability arising out of or in connection with the Terms and Conditions for any direct or indirect loss of or damage to profit, revenue, savings, data, use, contract, goodwill, opportunity or business, or any indirect or consequential loss or damage, in each case howsoever caused or arising.

The Competition and the Terms and Conditions are exclusively governed by the laws of Malaysia.
